Who We Are and What We do

Doug Barritt has more than 25 years of employment litigation and employment law advice and counsel experience. Perry Smith began representing employees more than thirteen years ago after a couple years of representing employers exclusively.  Paul Miner has more than a decade of employment litigation and advice and counsel experience and Carley Millian joined the firm in 2014 as a UCLA Law graduate and new member of the bar.  Barritt Smith LLP was formed in 2004 and has been representing employers, employees and executives since then.  We work in courts throughout Southern California.  We offer top firm quality for good rates or on a contingency fee basis (for employees).  We take our work very seriously and try to take ourselves not so seriously.

We handle wrongful termination claims, discrimination claims of all kinds, whistleblower claims, wage and hour claims, trade secrets claims and other employment-related claims.  Additionally, Doug Barritt offers consulting services to executives who require advice and counsel regarding employment agreements or other employment-related matters.

Paul Miner is the only one of three brothers not to become a cop and he speaks Cape Verdean Creole. Carley Millian and her husband just rescued their first dog. Her dad is a veterinarian, so that helps. Doug Barritt worked as a teen making pizza’s in his dad’s pizza restaurant — a place still making fantastic pizza in Whittier, CA. Perry Smith wrote a song that hit the top ten of the American Idol songwriting competition. Summary Judgment in Wrongful Termination Case

gavelDoug Barritt obtained summary judgment against an employee who brought a wrongful termination claim in Orange County Superior Court.  Doug has obtained summary judgment for employers multiple times throughout his career, even though such is a rare feat in the current litigation environment.

$400,000 Settlement in Disability Discrimination Case

gavelPerry Smith obtained a $400,000 settlement for an employee who was denied medical leave and terminated because of a request for accommodation for the employee’s disability.  The result was obtained without litigation.

Appeal of Decision on Motion to Compel Arbitration

Perry Smith prevailed on an employer’s appeal of a trial court’s decision to deny its Motion to Compel Arbitration.  Perry has prevailed in four out of his six appearances before the California Court of Appeal.

Summary Judgment in Wrongful Termination Case

Doug Barritt obtained summary judgment in a wrongful termination case brought in Orange County Superior Court.  Doug Barritt has obtained summary judgment in multiple cases. This has become a rarity in employment litigation, but Doug continues to have success.

Motion to Compel Discovery

Paul Miner prevailed on a discovery motion and obtained not only the substantive relief sought, but sanctions against the opposing party and counsel for their conduct.  Paul is skilled at avoiding discovery disputes, but continues to have success when a party is simply unwilling to cooperate in the manner required by law.
